1 About these terms

These Terms of Service govern your access to and use of PropGander. By starting, accessing or playing PropGander, you agree to these terms. If you do not agree, do not use PropGander.

PropGander is a free multiplayer prop-hunt party game provided as a Discord Activity. It is operated by:

In these terms:

• "PropGander" means the PropGander game, website, servers, software and related services;
• "operator", "I", "me" or "my" means Jamie Myland;
• "you" means the person accessing or using PropGander; and
• "Discord" means the third-party Discord service through which the PropGander Activity is accessed.

2 Eligibility

You must be legally permitted to use Discord and PropGander in your country.

You must meet Discord's applicable minimum-age requirements and comply with Discord's own terms, policies and community rules.

If you are below the age at which you can enter into a binding agreement independently in your country, you should use PropGander only with the permission of a parent or legal guardian.

You may not use PropGander if:

• you are below Discord's applicable minimum age;
• your use would violate applicable law;
• Discord has suspended or terminated your account;
• you have previously been blocked from PropGander for serious or repeated misuse; or
• you are using the service on behalf of someone who is not permitted to use it.

3 Discord account and access

A Discord account is normally required to use PropGander as a Discord Activity.

PropGander may receive limited account information from Discord, including your Discord user ID, username, display name and avatar reference.

You are responsible for:

• keeping your Discord account secure;
• ensuring the account belongs to you or that you are authorised to use it;
• complying with Discord's terms and policies;
• activity carried out through your account; and
• promptly reporting suspected compromise of your Discord account to Discord.

You must not share temporary PropGander gameplay tickets, Discord access tokens, authorisation codes or other session credentials with another person.

Access may depend on Discord confirming that you are a participant in the relevant Activity instance.

PropGander may refuse a connection if it cannot validate your session, if the game has reached capacity or if a technical or security check fails.

4 The service

PropGander is currently provided free of charge and may be described as a beta, playtest, preview or developing service.

Features may be incomplete, experimental or changed without notice. The game may contain bugs, balance issues, interruptions or loss of temporary match progress.

I may:

• add, change or remove game features;
• alter game rules, capacity or balancing;
• limit the number of players or active matches;
• carry out maintenance;
• reset temporary data;
• replace or discontinue servers;
• restrict access by platform, region or account;
• suspend a playtest;
• discontinue PropGander; or
• introduce paid or optional features in the future.

Any future payment terms will be presented before a purchase is made. PropGander currently has no payments or paid subscriptions.

There is no guarantee that beta progress, statistics, settings, access or features will continue into a later release.

5 Multiplayer conduct

PropGander is intended to be a light-hearted social game. You must treat other players reasonably and avoid conduct that makes the service unsafe or unusable.

You must not use PropGander to:

• harass, bully, threaten, stalk or abuse another person;
• engage in hateful, discriminatory or deliberately degrading conduct;
• share or encourage unlawful, harmful or exploitative material;
• impersonate another person or misrepresent your identity;
• misuse another person's Discord account or identity;
• deliberately disrupt matches or prevent others from playing;
• repeatedly target another player for reasons unrelated to ordinary gameplay;
• organise abuse or harassment through another platform;
• evade a suspension, restriction or ban;
• encourage another person to break these terms; or
• use the game in a way that violates Discord's rules.

6 Cheating and technical misuse

You must not:

• use cheats, automation, bots, macros or unauthorised tools to gain an unfair advantage;
• exploit bugs or vulnerabilities for an unfair, disruptive or harmful purpose;
• deliberately send invalid, excessive or manipulated network traffic;
• interfere with game servers, WebSocket connections, authentication or matchmaking;
• bypass or attempt to bypass player limits, instance limits, rate limits or capacity controls;
• forge or alter gameplay tickets, Discord credentials, instance identifiers or authentication data;
• connect to a game instance you are not authorised to join;
• probe, scan or test the service for vulnerabilities without prior written permission;
• carry out or assist a denial-of-service attack;
• introduce malware or malicious code;
• access or attempt to access server secrets, private source code, administrative systems or another player's data;
• scrape the service or systematically collect player information;
• intercept another player's communications or session credentials;
• reverse engineer PropGander except where applicable law expressly permits it and does not permit that right to be restricted;
• circumvent technical protection measures;
• create or distribute unauthorised copies or modified versions of PropGander; or
• use PropGander infrastructure to operate another service.

7 Display names and player information

PropGander uses names supplied through Discord to identify players within a game.

Your sanitised Discord display name may be visible to other players in:

• lobbies;
• player lists;
• announcements;
• match events; and
• scoreboards.

You must not use a Discord display name or profile presentation that:

• impersonates another player or the operator;
• is unlawful or seriously abusive;
• contains malicious code or attempts to interfere with the game;
• misleadingly suggests official authority; or
• violates Discord's rules.

PropGander may sanitise, shorten, replace or decline to display a name where reasonably necessary for safety, compatibility or presentation.

8 Reporting and enforcement

Suspected abuse, cheating or security issues may be reported to propgander.support@gmail.com.

Please include enough information to investigate the issue, but do not send passwords, Discord access tokens, gameplay tickets or other secret credentials.

Where reasonably necessary, I may:

• warn a player;
• remove a player from a match;
• temporarily or permanently block access;
• restrict access from particular accounts, sessions or network sources;
• preserve relevant security or abuse records;
• report conduct to Discord;
• report suspected criminal activity or serious threats to an appropriate authority; or
• take other proportionate steps to protect players and the service.

Enforcement decisions may take account of the seriousness of the conduct, the evidence available, previous behaviour, safety risks and the technical ability to identify the relevant account.

I am not required to provide advance notice where immediate action is reasonably necessary for security, safeguarding or service stability.

Because PropGander is currently a small, independently operated service, a formal appeal system may not always be available. You may nevertheless contact propgander.support@gmail.com if you believe a restriction was applied in error.

9 Intellectual property

PropGander and its original content are protected by copyright and other intellectual-property laws.

Except where stated otherwise, all rights in the following remain owned by Jamie Myland or the relevant licensors:

• the PropGander name and branding;
• game code;
• game design and mechanics as protected by law;
• artwork;
• characters;
• models;
• animations;
• sounds and music;
• writing and interface content;
• website content; and
• server and technical systems.

These terms give you a limited, personal, revocable, non-exclusive and non-transferable permission to access and play PropGander for lawful, non-commercial entertainment.

They do not transfer ownership of PropGander or its assets to you.

You may not reproduce, sell, license, distribute, publicly host or commercially exploit PropGander or its assets without written permission, except where applicable law expressly allows it.

Third-party software, assets and services may be subject to their own licences and terms.

Discord names, logos and services belong to Discord or its licensors. Google names, logos and services belong to Google or its licensors. PropGander is not owned or operated by Discord or Google.

10 Screenshots, streams and videos

You may normally capture and share screenshots, videos or livestreams of ordinary PropGander gameplay for personal, educational, review, commentary or creator purposes.

You must not use recordings to:

• harass or expose another player;
• disclose private or security-sensitive information;
• falsely imply official sponsorship or endorsement;
• distribute unreleased assets obtained through unauthorised access;
• facilitate cheating, exploitation or attacks; or
• violate Discord's rules or another person's rights.

Any music, third-party assets or platform content shown in a recording may remain subject to separate rights.

11 Feedback

You may voluntarily send ideas, bug reports or other feedback about PropGander.

You retain ownership of material you already own. However, by submitting feedback, you give me a worldwide, perpetual, irrevocable, non-exclusive, royalty-free licence to use, adapt and incorporate that feedback into PropGander without payment or an obligation to implement it.

Do not submit confidential information or material that you do not have permission to share.

12 Privacy

Personal information is handled as described in the PropGander Privacy Policy: https://www.propgander.com/privacy

The Privacy Policy explains:

• what information PropGander receives;
• why it is used;
• how long it is retained;
• which service providers are involved; and
• how to exercise your data-protection rights.

13 Third-party services

PropGander depends on services operated by other organisations, particularly Discord and Google Cloud.

Your use of those services is subject to their own terms and policies.

I do not control and am not responsible for:

• the general availability of Discord;
• the security of your Discord account;
• changes to Discord's Activity platform or APIs;
• Discord moderation or account decisions;
• internet-service failures;
• Google Cloud outages;
• browser, device or network incompatibility; or
• content and services independently provided by third parties.

A failure or change affecting a third-party service may prevent PropGander from operating.

14 Availability and changes

PropGander is provided on an "as available" basis.

I will take reasonable steps to operate and secure the service, but I do not promise that PropGander will:

• always be available;
• operate without interruption;
• be free from errors or vulnerabilities;
• support every device, browser or connection;
• preserve temporary match data;
• continue in its current form; or
• remain free indefinitely.

Access may be interrupted for maintenance, deployment, capacity management, security, provider outages or circumstances outside my reasonable control.

I may update these terms where reasonably necessary to reflect:

• changes to the game;
• changes to Discord or hosting services;
• new safety or security requirements;
• changes in the law; or
• changes to how PropGander is operated.

Updated terms will be published at https://www.propgander.com/terms.

The effective date will be changed when the terms are updated. If a change is material, reasonable steps may be taken to provide additional notice.

Continuing to use PropGander after revised terms take effect means that you accept the revised terms. This does not affect rights that cannot lawfully be changed without your express agreement.

15 Disclaimer

Nothing in these terms excludes promises, guarantees or rights that cannot legally be excluded.

Subject to that qualification, PropGander is a free and developing game provided without an express guarantee that it will be uninterrupted, error-free, secure, compatible with every device or suitable for a particular purpose.

You use PropGander at your own discretion.

You should not rely on PropGander to store important information. Match state, statistics and settings may be lost because of disconnection, restart, deployment, software error or service closure.

16 Limitation of liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for:

• death or personal injury caused by negligence;
• fraud or fraudulent misrepresentation; or
• any other liability that cannot legally be excluded or limited.

Nothing in these terms affects your statutory rights as a consumer.

Subject to those protections, I will not be liable for losses that:

• were not reasonably foreseeable when you agreed to these terms;
• result from your breach of these terms;
• result from misuse of your Discord account;
• arise from an outage or change to Discord, Google Cloud, your internet provider or another third-party service;
• concern the loss of temporary gameplay progress or match statistics;
• are business or commercial losses arising from personal use of the game; or
• arise from unauthorised tools, modifications, cheats or third-party software.

Where I am legally liable for loss arising directly from the provision of this free service, liability will be limited to a reasonable amount taking account of the fact that PropGander was supplied without charge, except where a higher or unlimited amount is required by law.

This section is intended to allocate risk reasonably. It is not intended to remove legal rights that apply to you as a consumer.

17 Indemnity for commercial or unlawful misuse

If you use PropGander on behalf of a business, or deliberately use it for unlawful attacks, unauthorised commercial exploitation or infringement of another person's rights, you will be responsible for reasonable losses, liabilities and costs directly caused by that misuse.

This section does not apply to ordinary consumer use or accidental conduct and does not require you to compensate me for losses caused by my own negligence or breach.

18 Suspension and termination

You may stop using PropGander at any time.

I may suspend or terminate your access where reasonably necessary because:

• you have materially or repeatedly breached these terms;
• your activity creates a security or safeguarding risk;
• your use disrupts the game or other players;
• I am required to do so by law or by a platform provider;
• the relevant Discord account or Activity instance cannot be validated;
• continued access would expose PropGander or another person to legal liability; or
• the service is being closed or substantially changed.

When access ends, the permission granted under these terms also ends.

Sections concerning intellectual property, liability, enforcement, disputes and any provisions that by their nature should continue will survive termination.

19 Events outside reasonable control

I will not be responsible for delay, interruption or failure caused by events outside my reasonable control.

These may include:

• internet or telecommunications failure;
• Discord or Google Cloud outages;
• denial-of-service attacks;
• widespread security incidents;
• failures by hosting or domain providers;
• changes to third-party APIs or platform rules;
• power failures;
• natural disasters;
• government action; or
• other events that could not reasonably have been prevented.

Reasonable steps will be taken to restore or protect the service where practical.

20 Governing law and disputes

These terms and any non-contractual dispute relating to PropGander are governed by the law of England and Wales.

If you live in England or Wales, the courts of England and Wales will have jurisdiction.

If you live in Scotland or Northern Ireland, you may also be entitled to bring proceedings in your local courts under applicable consumer law.

If you live elsewhere, mandatory consumer protections and local jurisdiction rights that apply in your country are not excluded by these terms.

Before beginning formal proceedings, you are encouraged to contact propgander.support@gmail.com. This gives both sides an opportunity to understand and try to resolve the issue informally.

21 General provisions

21.1 Entire agreement

These terms and the Privacy Policy form the agreement between you and me concerning your use of PropGander, together with any additional terms clearly presented for a particular feature.

21.2 No waiver

If I do not immediately enforce a provision of these terms, that does not mean I have waived the right to enforce it later.

21.3 Severability

If a court finds part of these terms unlawful or unenforceable, the remaining provisions will continue to apply. The affected provision will be interpreted or modified only as much as necessary to make it lawful and enforceable.

21.4 Transfer

You may not transfer your rights under these terms to another person without written permission.

I may transfer the operation of PropGander and the associated rights and responsibilities to another person or organisation, provided that doing so does not reduce your mandatory consumer rights. Where appropriate, notice of such a transfer will be given.

21.5 No third-party enforcement

Unless these terms expressly state otherwise, a person who is not a party to them has no right to enforce them under the Contracts (Rights of Third Parties) Act 1999.
